Extension of the deadline for exercising the powers provided for in Article 2 of Law No. 106 of 15 July 2022 (Entertainment Code)

It is currently under review by the Chamber of Deputies, starting on Monday, 4 August 2025., the bill extending the deadline for exercising the powers delegated under Article 2 of Law No. 106 of 15 July 2022 on entertainment (AC 2538).

The measure, approved by the Council of Ministers on 12 June 2025, was initially examined by the Senate, which approved it with amendments at its sitting on 24 July 2025. Subsequently, it was forwarded to the Chamber of Deputies, where it was assigned to the Culture Committee, which examined it from 28 to 31 July 2025, confirming the text from the Senate without further amendments.

The bill, in its current form, consists of two articles:

  • Article 1: extension of the deadline for exercising delegated powers;
  • Article 2: Entry into force.

In particular Article 1 provides for the extension from 18 August 2025 to 31 December 2026 of the deadline for exercising the powers referred to in Article 2, paragraphs 1, 4 and 5, of Law No. 106 of 2022 (‘Entertainment Code’).

The delegations concerned are as follows:

  • Delegation for the coordination and reorganisation of current provisions governing the activities, organisation and management of opera and symphony foundations, as well as for the reform, revision and reorganisation of regulations in the fields of theatre, music, dance, travelling shows, circus activities, historical carnivals and historical re-enactments, through the drafting of a single regulatory text called the Entertainment Code..Objectives: a more effective and organic structure for the sector, administrative simplification, optimisation of expenditure, gender rebalancing, improvement of artistic and cultural quality, incentives for production, innovation and enjoyment by the community, with particular attention to lifelong learning (Art. 2, c.1, Law 106/2022;;
  • Delegation for the adoption of provisions on employment contracts in the entertainment sector (Art. 2, para. 4, Law 106/2022);
  • Delegation for the adoption of provisions on fair compensation or self-employed workers in the entertainment industry, including agents and representatives of live entertainment (Art. 2, para. 5, Law 106/2022).

It should be noted that, compared to the initial text prepared by the Government, the Senate has removed the reference to the delegation referred to inArticle 2, paragraph 6, Law 106/2022,concerning the reorganisation and revision of social safety nets and allowances and the introduction of a discontinuity allowance for intermittent workers in the entertainment sector. This delegation has already been implemented with the D.Lgs. n. 175/2023.

Article 2states that the law shall enter into force on the day following its publication in the Gazzetta Ufficiale.
