User-Uploaded Content on Sharing Platforms and Copyright Infringement: Agcom Adopts Measures on Complaints and Disputes

The guidelines (Annex A of the resolution) outline the general principles and criteria that online content-sharing service providers must follow to ensure their users have fast and effective complaint mechanisms against the removal or disabling of content due to copyright infringement.

Specifically, the complaint procedure allows users, through clear and transparent methods, to challenge the platform’s decision. The platform is required to disclose the reasons for its actions, specifying the justifications provided by copyright holders or other authorized parties.
Users can appeal the platform’s decision on the complaint before AGCOM, which will determine the legitimacy of the platform’s decision according to the procedural regulations (Annex B of the resolution).
