Law no. 2023 of 24 February 2023 was published in the Official Gazette. 14, of ‘Conversion into law, with amendments, of Decree-Law no. 29 December 2022, no. 198, containing “Urgent provisions on legislative deadlines” (so-called milleproroghe).

It includes in Article 7 the extension of legislative deadlines in the area of Culture, in particular:

– Delegation of powers to the Government for the reorganisation of the legal provisions on entertainment (Art. 1(6)): In Article 2 of Law no. 106, the term “nine months” is replaced everywhere by “twenty-four months”.

The deadline for submitting the implementing decrees of the Entertainment Code is extended until 18 August 2024.

– Extension to film projections of the simplifications for the realisation of live performances and film projections provided for in Art. 38-bis of Decree-Law no. 16 July 2020, no. 76, converted, with amendments, by Law No. 11 September 2020, no. 120 (Art. 7 (7-sexies)).

The law also provides for simplifications for the organisation of live performances (theatre, music, dance and musicals) with a maximum of 1,000 participants:
in fact, it extends to 31 December 2023, the possibility of replacing the issuance of any act of authorisation, licence, non-constitutive concession, permit or nullaosta, required for the organisation of live performances held between 8 a.m. and 1 a.m., with a certificate of commencement of activity pursuant to Article 19 of Law No. 19 of 7 August 1990, no. 1. 00 a.m. and 1 a.m., if dependent exclusively on the verification of the requirements of general content regulations, with a certificate of commencement of activities pursuant to Article 19 of Law no. 7 August 1990, no. 241, submitted by the interested party to the one-stop shop for productive activities or similar office.

The simplifications provided for in Art. 38-bis of Decree-Law no. 16 July 2020, no. 76 on live performances and film screenings are extended and prolonged until 31 December 2023.

– The members of the Consultative Commissions for the Performing Arts at the Ministry of Culture, appointed by Ministerial Decrees no. 18 (Dance), 19 (Circus and Travelling Show) and 20 (Theatre) of 19 January 2022 and no. 39 of 25 January 2022 (Music), remain in office until 31 December 2023 (Art. 7, para. 7-septies), extending the exercise of their functions until the appointment of new members.

The members of the Advisory Commissions for the Performing Arts at the Ministry of Culture remain in office until 31 December 2023.

– It is envisaged (Art. 7, paragraph 7-bis) that the distribution of the share of the Single Fund for Performing Arts allocated to the lyrical-symphonic foundations for 2023 will be based on the average of the percentages established for the three-year period 2017-2019. In addition, the deadline by which to submit reports for the activity carried out in 2022 is postponed to 30 June 2023, taking into account the health emergency and the consequent need to protect employment and the rescheduling of shows.

Extension to 30 June 2023 of the deadlines for the submission of accounts and to the 2017-2019 period for the basis of calculation of the allocation of the FUS share to the lyrical-symphonic foundations for 2023.
